近日,藥(yao)品(pin)監督管(guan)理總局(ju)發(fa)布《網絡(luo)餐(can)飲服(fu)務(wu)食品(pin)安全監督管(guan)理辦法》,明確規定入網餐(can)飲服(fu)務(wu)提供者應當具有實(shi)體(ti)經營(ying)門店并依法取得食品(pin)經營(ying)許可證。
食(shi)(shi)藥監總(zong)局相關人士表示,隨著我國互聯網經濟(ji)的迅(xun)猛發展,“互聯網+餐(can)(can)飲(yin)(yin)(yin)服(fu)務”等(deng)新興業態快速增長(chang)。但(dan)存在(zai)(zai)(zai)第三方(fang)平(ping)(ping)臺(tai)(tai)責任落實(shi)不到位,對(dui)入(ru)網餐(can)(can)飲(yin)(yin)(yin)服(fu)務者審查把關不嚴,入(ru)網餐(can)(can)飲(yin)(yin)(yin)服(fu)務提供者的食(shi)(shi)品安全(quan)意識(shi)不高、經營管理水平(ping)(ping)有限、經營條件(jian)較簡陋,食(shi)(shi)品安全(quan)存在(zai)(zai)(zai)隱患等(deng)現象。根據現階段網絡(luo)餐(can)(can)飲(yin)(yin)(yin)存在(zai)(zai)(zai)的問(wen)題(ti),《辦(ban)法》指出(chu)開展網絡(luo)餐(can)(can)飲(yin)(yin)(yin)服(fu)務食(shi)(shi)品安全(quan)監測,實(shi)行“線上線下(xia)一致”原則,同時(shi)對(dui)平(ping)(ping)臺(tai)(tai)和入(ru)網餐(can)(can)飲(yin)(yin)(yin)服(fu)務提供者義務、送(song)餐(can)(can)人員和送(song)餐(can)(can)過程要求做出(chu)了明確(que)規定。
《辦法》規(gui)定,入(ru)網餐(can)飲(yin)服務(wu)(wu)提(ti)(ti)供(gong)(gong)者(zhe)應(ying)當具有實(shi)體經(jing)營(ying)(ying)門店并依法取得食(shi)品經(jing)營(ying)(ying)許(xu)可證(zheng),并按照食(shi)品經(jing)營(ying)(ying)許(xu)可證(zheng)載明(ming)的(de)主(zhu)體業態、經(jing)營(ying)(ying)項(xiang)目從事經(jing)營(ying)(ying)活(huo)動,不得超范圍經(jing)營(ying)(ying)。縣級以上地方(fang)食(shi)品藥品監督管(guan)理部門查處的(de)入(ru)網餐(can)飲(yin)服務(wu)(wu)提(ti)(ti)供(gong)(gong)者(zhe)有嚴重違(wei)法行為(wei)的(de),應(ying)當通知網絡餐(can)飲(yin)服務(wu)(wu)第三方(fang)平臺提(ti)(ti)供(gong)(gong)者(zhe),要求其立(li)即停止對入(ru)網餐(can)飲(yin)服務(wu)(wu)提(ti)(ti)供(gong)(gong)者(zhe)提(ti)(ti)供(gong)(gong)網絡交易平臺服務(wu)(wu)。
此外(wai),網絡餐(can)(can)飲(yin)(yin)服務(wu)第三方平(ping)臺提供(gong)者需要履行(xing)建立(li)食(shi)品(pin)(pin)安(an)全(quan)相關制(zhi)度,設(she)置專門(men)的食(shi)品(pin)(pin)安(an)全(quan)管(guan)理機構,配備專職食(shi)品(pin)(pin)安(an)全(quan)管(guan)理人員,審查登(deng)記并公示入(ru)網餐(can)(can)飲(yin)(yin)服務(wu)提供(gong)者的許可信(xin)息(xi),如(ru)實(shi)記錄(lu)網絡訂(ding)餐(can)(can)的訂(ding)單信(xin)息(xi),對入(ru)網餐(can)(can)飲(yin)(yin)服務(wu)提供(gong)者的經營行(xing)為進行(xing)抽查和監測等義務(wu)。
送(song)(song)(song)餐(can)方面,《辦法》規定,送(song)(song)(song)餐(can)人(ren)(ren)(ren)員應當保(bao)持(chi)個人(ren)(ren)(ren)衛(wei)生(sheng),使用安全、無害的(de)(de)配(pei)(pei)送(song)(song)(song)容(rong)器(qi),保(bao)證(zheng)(zheng)配(pei)(pei)送(song)(song)(song)過程食品不受污染;送(song)(song)(song)餐(can)單位要加強對送(song)(song)(song)餐(can)人(ren)(ren)(ren)員的(de)(de)培訓(xun)和管(guan)理;配(pei)(pei)送(song)(song)(song)有(you)保(bao)鮮、保(bao)溫、冷藏或(huo)冷凍等特殊要求食品的(de)(de),要采取能保(bao)證(zheng)(zheng)食品安全的(de)(de)保(bao)存、配(pei)(pei)送(song)(song)(song)措施。
